Module 1 – Legal Duties & Driver Protection
1. The Chain of Responsibility
Road safety is a shared legal duty. It is not just down to one person. The DVSA and Traffic Commissioner view this as a chain of responsibility:
- The Driver: You are legally responsible for the condition of the vehicle while it is in use. You must report defects.
- The Transport Manager (TM): Responsible for the continuous and effective management of the maintenance system.
- The Operator (Company): The licence holder has the ultimate responsibility.
Carrying out a detailed check is your insurance policy. If you sign for a vehicle as "Roadworthy," you accept responsibility for it.
- Fixed Penalty Notice: Immediate fines.
- Penalty Points: 3 points per tyre.
- Prohibition (PG9): Vehicle banned.
- Conduct Hearing: Risk of losing vocational licence.
